Terms of Service

Welcome to SkoolMotion. These Terms of Service ("Terms") govern your use of the SkoolMotion mobile application and website (collectively, the "Service") operated by Skool Motion Inc. ("SkoolMotion," "we," "us," or "our").
Important: By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Service Description
SkoolMotion provides school transportation services connecting parents/guardians with certified drivers for the transportation of children to and from school and related activities. Our Service includes:
- Scheduled daily school transportation
- On-demand ride requests
- Real-time GPS tracking of rides
- In-app communication and notifications
- Payment processing and ride management
SkoolMotion operates in the Greater Boston area. Service availability may vary by location.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Be the parent or legal guardian of the child(ren) being transported, or have written authorization from the parent/guardian
- Provide accurate and complete information during registration
- Have the legal authority to bind yourself to these Terms
3. Account Registration
To use our Service, you must create an account and provide:
- Your legal name and contact information
- Your child's name, school, and relevant transportation details
- Emergency contact information
- Valid payment information
- Authorized pickup persons (if applicable)
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.
4. Service Plans and Pricing
4.1 Scheduled Rides
We offer scheduled ride plans based on:
- Distance from pickup location to school
- Frequency (morning only, afternoon only, or round trip)
- School year or monthly billing cycles
Scheduled rides are billed in advance. Pricing is displayed in the app before you confirm your plan.
4.2 On-Demand Rides
On-demand rides are available based on driver availability and are charged per ride. Pricing is displayed before you confirm each ride.
4.3 Sibling Discounts
Discounts may be available for multiple children from the same household. Discounts are automatically applied when eligible.
5. Payment Terms
- All fees are charged to the payment method on file
- Scheduled plans are billed in advance (monthly or per semester)
- On-demand rides are charged at the time of booking
- You authorize us to charge your payment method for all fees incurred
- Prices are subject to change with 30 days notice
6. Cancellations and Refunds
6.1 Ride Cancellations
- Scheduled Rides: Cancel individual rides at least 2 hours before pickup time at no charge. Late cancellations may not be refunded.
- On-Demand Rides: Cancel within 5 minutes of booking for a full refund. Cancellations after driver dispatch may incur a cancellation fee.
6.2 Plan Cancellations
- You may cancel your scheduled plan at any time
- Refunds for unused portions are prorated based on the remaining service period
- Cancellations take effect at the end of the current billing period unless immediate cancellation is requested
6.3 Refund Processing
Approved refunds are processed within 5-10 business days to the original payment method.
7. Safety and Conduct
7.1 Our Commitment
We are committed to providing safe transportation. All SkoolMotion drivers:
- Hold valid Massachusetts 7D certification
- Pass comprehensive background checks including criminal and SORI (Sex Offender Registry Information) checks
- Maintain current medical clearance
- Drive vehicles that pass state 7D safety inspections twice yearly
- Carry appropriate insurance coverage
7.2 Your Responsibilities
As a user of the Service, you agree to:
- Ensure your child is ready for pickup at the scheduled time
- Provide accurate pickup and dropoff locations
- Keep your account information and authorized pickup persons current
- Inform us of any special needs, medical conditions, or accommodations your child requires
- Treat drivers with respect
- Not request transportation for illegal purposes
7.3 Child Conduct
Children must follow driver instructions and behave safely during transport. We reserve the right to suspend service for children who repeatedly engage in unsafe or disruptive behavior, after notification to parents.
8. Pickup and Dropoff Procedures
- Drivers will wait up to 5 minutes at pickup locations
- If a child is not present at pickup, the driver will attempt to contact the parent/guardian before departing
- Children will only be released to authorized individuals listed in the app
- ID verification may be required for pickup
- Parents are responsible for supervision before pickup and after dropoff
9. Service Interruptions
We strive to provide reliable service but cannot guarantee uninterrupted availability. Service may be affected by:
- Severe weather conditions
- School closures or schedule changes
- Traffic or road conditions
- Driver unavailability
- Vehicle mechanical issues
- Emergencies or unforeseen circumstances
We will notify you as soon as possible of any service disruptions and work to arrange alternative transportation when feasible.
10. Limitation of Liability
To the maximum extent permitted by law:
- SkoolMotion's total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not responsible for delays or failures caused by circumstances beyond our reasonable control
Some jurisdictions do not allow limitation of liability for certain damages, so some of these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless SkoolMotion, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any inaccurate information you provide
12. Intellectual Property
The SkoolMotion name, logo, app, website, and all related content are the property of Skool Motion Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
14. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
15. Termination
We may suspend or terminate your access to the Service:
- If you violate these Terms
- If you fail to pay fees when due
- If we discontinue the Service in your area
- For any other reason with reasonable notice
You may terminate your account at any time through the app or by contacting us. Upon termination, your right to use the Service ceases immediately.
16. Dispute Resolution
16.1 Informal Resolution
Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
16.2 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.
16.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions or class-wide arbitration.
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any legal proceedings shall be conducted in the state or federal courts located in Suffolk County, Massachusetts.
18. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SkoolMotion.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver.
- Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
